1. Acceptance of Terms
By accessing or using ForeclosureLeads.us (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
ForeclosureLeads.us provides monthly compilations of publicly recorded foreclosure-related documents (including but not limited to notices of trustee sale, deed of trust recordings, and related instruments) sourced from Texas county public records. The data is collected, processed, and organized using automated tools, including artificial intelligence and machine learning technologies.
3. Right to Terminate and/or Deny Service
ForeclosureLeads.us reserves the right to discontinue and terminate any part or all of the services it provides on or through this website at any moment.
ForeclosureLeads.us reserves the right to terminate the service or deny service to any individual account holder or prospective user for any reason. ForeclosureLeads.us shall be under no obligation to provide reason for termination or denial of service to such user.
ForeclosureLeads.us will make its best attempt to notify all active account holders with subscription service via email associated with the account at least 3 days prior to termination to allow them to save or export any data in their account at that time. Said notice shall be sufficient for the purposes of this agreement.
4. Data Accuracy Disclaimer
THE DATA PROVIDED THROUGH THIS SERVICE IS COLLECTED AND PROCESSED WITH THE USE OF AUTOMATED AND AI-ASSISTED TOOLS. FORECLOSURELEADS.US MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, COMPLETENESS, TIMELINESS, RELIABILITY, OR FITNESS FOR A PARTICULAR PURPOSE OF ANY DATA PROVIDED.
Data may be incomplete, inaccurate, contain errors, omissions, or outdated information. Records may fail to capture all filings, may misattribute information, or may contain processing errors introduced during automated collection or parsing. Users are solely responsible for independently verifying any data before relying on it for any purpose.
5. No Financial, Legal, or Investment Advice
The Service provides data only. Nothing on this platform constitutes financial, legal, investment, real estate, or tax advice. ForeclosureLeads.us does not guarantee any financial outcome, investment return, or result from the use of this data. All investment decisions are made solely at the user’s own risk and discretion.
6. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FORECLOSURELEADS.US, ITS OWNERS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) RELIANCE ON ANY DATA PROVIDED BY THE SERVICE; (C) ERRORS, OMISSIONS, OR INACCURACIES IN THE DATA; OR (D) ANY OTHER MATTER RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In no event shall our total liability to you exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.
7. AI and Automated Data Collection Disclosure
Data provided through this Service is gathered using automated web scraping tools and may be enhanced, parsed, or processed using artificial intelligence technologies. As a result, the data may contain errors that a human reviewer would not make, may miss records that were not captured during the automated collection window, or may contain hallucinated or incorrectly attributed information. Users acknowledge this limitation and assume all responsibility for verification.
8. Permitted Use
The data is licensed for your personal and professional use only. You may not resell, redistribute, sublicense, or otherwise commercialize the raw data without prior written consent. You may use the data to identify properties, conduct research, or support legitimate real estate business activities.
9. Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
10. Subscription And Billing
10.1 Free Trial
Eligible new subscribers may receive one 21-day free trial beginning when their verified account is created. No credit card is required to begin the trial. During the trial, the subscriber may access all counties for which ForeclosureLeads.us has published data. The trial ends automatically at the stated expiration time, does not pause due to nonuse, and does not automatically convert to a paid subscription or create a charge. Trial eligibility is determined by ForeclosureLeads.us, and creating an additional account does not create an additional trial entitlement.
10.2 County Subscriptions And Pricing
After the trial, continued access requires a paid subscription. Subscribers select one or more individual counties from the counties then offered by the Service. The monthly price for each selected county and the total recurring monthly charge are displayed before purchase. Paid access is limited to the counties included in the confirmed subscription and to the data and documents published for those counties. County coverage, available data fields, record counts, and document availability may vary.
10.3 Recurring Payment Authorization
By submitting a paid subscription, you authorize ForeclosureLeads.us and its payment processor, Stripe, to charge the payment method you provide for the displayed subscription total, plus any applicable taxes, on a recurring monthly basis until the subscription is canceled or changed. Your billing date and the amount due are shown during checkout or in your billing account. Prices are stated in U.S. dollars unless expressly indicated otherwise.
10.4 Billing Cycle And Renewals
Your first paid billing cycle begins when your initial subscription payment is successfully completed. Unless canceled, the subscription renews monthly using the billing date maintained by Stripe. You are responsible for keeping your payment and billing information current. A change to your subscription may change the amount charged at the next renewal or may create a separately disclosed prorated charge.
10.5 County Plan Changes
You may change your selected counties no more than one time during a billing cycle. Any available change options, charges, and effective dates will be displayed for confirmation before the change is submitted. An added county may take effect immediately after successful payment of the displayed prorated charge for the remainder of the current billing cycle, or at the next renewal when that option is offered. A removed county ordinarily remains accessible through the end of the current paid billing cycle and is removed at the next renewal. No refund or credit is issued for the remaining portion of a removed county’s current billing cycle. A change that both adds and removes counties follows these rules separately for the additions and removals.
10.6 Cancellation
You may cancel recurring subscription billing through the billing-management options made available from your Account page or by contacting us through our Contact page. Unless otherwise disclosed at the time of cancellation, cancellation takes effect at the end of the current paid billing period, access continues through that date, and no further recurring charge will be made. Deleting your ForeclosureLeads.us account is different from an end-of-cycle cancellation: account deletion may immediately terminate access and does not create a refund or credit.
10.7 Failed Payments And Suspension
If a payment is declined, reversed, disputed, or otherwise not successfully collected, the subscription may be marked past due and access may be restricted or suspended. Access may be restored after the outstanding payment is successfully collected or a valid payment method is provided. ForeclosureLeads.us may cancel a subscription that remains unpaid.
10.8 Refunds And Credits
Because the Service provides immediate access to digital data and documents, subscription and prorated charges are generally nonrefundable. Cancellation, account deletion, or removal of a county does not create a refund or credit for a partially used billing period. Exceptions may be made for a verified billing error or when required by applicable law. Questions about a charge should be submitted promptly through our Contact page.
10.9 Payment Processing
Payments are processed by Stripe and are also subject to Stripe’s applicable terms and privacy practices. ForeclosureLeads.us does not store your full credit card number. We may store Stripe customer, subscription, invoice, payment-status, and related transaction identifiers needed to administer your account and provide access to the Service.
10.10 Price And Offering Changes
ForeclosureLeads.us may change county availability, subscription prices, or plan structure. Any change affecting the recurring price of an existing subscription will not alter a charge already paid for the current billing cycle and will be disclosed before the new price is charged, as required by applicable law. Continued use of a paid subscription after the effective date of a disclosed price change constitutes acceptance of the new price.
10.11 Electronic Acceptance
Paid enrollment or a plan change may require you to review a transaction-specific subscription agreement, confirm the selected counties and charges, and type your name as an electronic signature. By submitting that confirmation, you agree that your electronic action constitutes your signature and your acceptance of the displayed agreement, prices, billing schedule, and effective dates. The transaction-specific agreement supplements these Terms and controls the specific counties, amounts, and effective dates that you accepted.
11. Privacy
Your use of the Service is also governed by our Privacy Policy.
12. Modifications
We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
